Jason, who has submitted similar legislation for consideration in the past, has not seen such a stringent statute make it through the Legislature and reach the governor's desk for consideration.

But he said the issue has become serious enough for him to continue trying.

"It frustrates me," Hudson said. "I don't know if we're going to get it done or not, but I'm going to keep on trying as long as I'm there.

And while many of his legislative colleagues from the Pine Belt agree with the sentiment and could see a stiffening of the state's current laws, they're not sure that an outright ban would pass muster.

"Generally, the House is a little more cautious when passing laws on cellphone issues," said Rep. Toby Barker, R-Hattiesburg.

But Hudson said it is time for Mississippi to catch up with its fellow states.

"I don't exactly remember the numbers, but 30-something states have texting (laws) and six states have cellphone (laws), and we don't have anything," Hudson said. "But, we're usually last, and it looks like we're going to be last again."

Mississippi's current laws ban school bus drivers from using a cellphone to call or text while driving. The state also is one of seven that prohibit those holding learner's permits and intermediate driver's licenses from texting and driving.

Nationally, 10 states - California, Connecticut, Delaware, Maryland, Nevada, New Jersey, New York, Oregon, Utah and Washington - and the District of Columbia ban the use of handheld devices by all drivers.

Text messaging is banned for all drivers in 35 states and D.C., while another seven - including Mississippi - place restrictions on novice and bus drivers.

"So, many other states have taken the lead," said Rep. Percy Watson, D-Hattiesburg. "I support a ban on texting and driving because it's extremely dangerous, but I don't have a real feel for how something like that would be seen by my colleagues."
